    REGISTRATION OF PERSONAL DATA<\/h4>\n

    In compliance with the provisions of the RGPD and the LOPD-GDD, we inform you that\nthe personal data collected by Argotek, through the forms provided on its pages will be\nincorporated and processed in our file in order to facilitate, expedite and fulfil the\ncommitments established between Argotek and the User or the maintenance of the\nrelationship established in the forms filled in by the User, or to respond to a request or\nquery from the User. Likewise, in accordance with the provisions of the RGPD and the\nLOPD-GDD, unless the exception provided for in article 30.5 of the RGPD is applicable, a\nregister of processing activities is kept which specifies, according to its purposes, the\nprocessing activities carried out and the other circumstances established in the RGPD.<\/p>\n

    PRINCIPLES APPLICABLE TO THE PROCESSING OF PERSONAL DATA<\/h4>\n

    The processing of the User's personal data shall be subject to the following principles set\nout in Article 5 of the GDPR and in Article 4 et seq. of Organic Law 3\/2018, of 5 December,\non the Protection of Personal Data and the guarantee of digital rights:<\/p>\n

    • Principle of lawfulness, fairness and transparency: the consent of the User shall be\nrequired at all times following fully transparent information on the purposes for\nwhich the personal data are collected.<\/li>\n
    • Purpose limitation principle: personal data will be collected for specified, explicit\nand legitimate purposes.<\/li>\n
    • Principle of data minimisation: personal data collected will be only that which is\nstrictly necessary in relation to the purposes for which they are processed.<\/li>\n
    • Accuracy principle: personal data must be accurate and always up to date.<\/li>\n
    • Principle of limitation of the storage period: personal data shall only be kept in a\nform that allows the identification of the User for the time necessary for the\npurposes for which they are processed.<\/li>\n
    • Principle of integrity and confidentiality: personal data shall be processed in such a\nway as to ensure their security and confidentiality.<\/li>\n
    • Principle of proactive responsibility: the Controller shall be responsible for ensuring\nthat the above principles are complied with.<\/li>\n<\/ul>\n

      CATEGORIES OF PERSONAL DATA<\/h4>\n

      The categories of data processed by\u00a0Argotek<\/span>\u00a0are solely identification data. Under no\ncircumstances are special categories of personal data processed within the meaning of\nArticle 9 of the GDPR.<\/p>\n

      LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA<\/h4>\n

      The legal basis for the processing of personal data is consent.\u00a0Argotek<\/span>\u00a0undertakes to\nobtain the express and verifiable consent of the User to the processing of his or her\npersonal data for one or more specific purposes.<\/p>\n

      The User shall have the right to withdraw his\/her consent at any time. It will be as easy to\nwithdraw consent as it is to give it. As a general rule, withdrawal of consent shall not\ncondition the use of the Website.<\/p>\n

      On those occasions when the User must or may provide their data through forms to make\nenquiries, request information or for reasons related to the content of the Website, they\nwill be informed in the event that the completion of any of them is compulsory due to the\nfact that they are essential for the correct development of the operation carried out.<\/p>\n

      PURPOSES OF THE PROCESSING FOR WHICH THE PERSONAL DATA IS USED<\/h4>\n

      The personal data is collected and managed by Argotek for the purpose of being able to\nfacilitate, speed up and fulfil the commitments established between the Website and the\nUser or the maintenance of the relationship established in the forms that the latter fills in\nor to attend to a request or query.<\/p>\n

      Likewise, the data may be used for the commercial purpose of personalisation,\noperational and statistical purposes, and activities inherent to Argotek's corporate\npurpose, as well as for the extraction, storage of data and marketing studies to adapt the\nContent offered to the User, as well as to improve the quality, operation and browsing of\nthe Website.<\/p>\n

      At the time the personal data is obtained, the User will be informed of the specific\npurpose or purposes of the processing for which the personal data will be used; that is to\nsay, the use or uses to which the information collected will be put.<\/p>\n

      RETENTION PERIODS OF PERSONAL DATA<\/h4>\n

      Personal data will only be retained for the minimum time necessary for the purposes of\ntheir processing and, in any case, only for the following period: 24 months, or until the\nUser requests their deletion.<\/p>\n

      At the time the personal data is obtained, the User will be informed of the period for\nwhich the personal data will be retained or, where this is not possible, the criteria used to\ndetermine this period.<\/p>\n

      RECIPIENTS OF PERSONAL DATA<\/h4>\n

      The User's personal data will not be shared with third parties.<\/p>\n

      In any case, at the time the personal data is collected, the User will be informed of the\nrecipients or categories of recipients of the personal data.<\/p>\n

      PERSONAL DATA OF MINORS<\/h4>\n

      In compliance with the provisions of articles 8 of the GDPR and 7 of Organic Law 3\/2018, of\n5 December, on the Protection of Personal Data and the guarantee of digital rights, only those over 14 years of age may give their consent to the processing of their personal data\nin a lawful manner by Argotek. In the case of a minor under 14 years of age, the consent of\nthe parents or guardians is required for the processing, and this will only be considered\nlawful to the extent that they have authorised it.<\/p>\n

      SECRECY AND SECURITY OF PERSONAL DATA<\/h4>\n

      Argotek undertakes to adopt the necessary technical and organisational measures,\naccording to the level of security appropriate to the risk of the data collected, so as to\nguarantee the security of personal data and prevent the accidental or unlawful\ndestruction, loss or alteration of personal data transmitted, stored or otherwise processed,\nor the unauthorised communication of or access to such data.<\/p>\n

      The Website is SSL (Secure Socket Layer) certified, which ensures that personal data is\ntransmitted securely and confidentially, as the transmission of data between the server\nand the User, and in return, is fully encrypted or encoded.<\/p>\n

      However, because Argotek cannot guarantee the impregnability of the Internet or the\ntotal absence of hackers or others who fraudulently access personal data, the Data\nController undertakes to notify the User without undue delay when a breach of security of\npersonal data occurs that is likely to entail a high risk to the rights and freedoms of natural\npersons. In accordance with Article 4 of the GDPR, a breach of security of personal data\nmeans any breach of security resulting in the accidental or unlawful destruction, loss or\nalteration of personal data transmitted, stored or otherwise processed, or the\nunauthorised disclosure of or access to such data.<\/p>\n

      Personal data shall be treated as confidential by the Controller, who undertakes to inform\nand to ensure by means of a legal or contractual obligation that such confidentiality is\nrespected by its employees, associates, and any person to whom it makes the information\naccessible.<\/p>\n

      RIGHTS DERIVING FROM THE PROCESSING OF PERSONAL DATA<\/h4>\n

      The User has over Argotek and may, therefore, exercise against the Data Controller the\nfollowing rights recognised in the RGPD and Organic Law 3\/2018, of 5 December, on the\nProtection of Personal Data and the guarantee of digital rights:<\/p>\n

      • Right of access:<\/i> this is the User's right to obtain confirmation as to whether or not\nArgotek is processing their personal data and, if so, to obtain information about\ntheir specific personal data and the processing that Argotek has carried out or is\ncarrying out, as well as, among other things, the information available on the origin\nof said data and the recipients of the communications made or planned for said\ndata.<\/li>\n
      • Right of rectification:<\/i>\u00a0This is the User's right to have his or her personal data that\nproves to be inaccurate or, taking into account the purposes of the processing,\nincomplete, amended<\/li>\n
      • Right of erasure (\"the right to be forgotten\"):<\/i>\u00a0This is the User's right, unless\notherwise provided for by law, to obtain the erasure of his or her personal data\nwhen it is no longer necessary for the purposes for which it was collected or\nprocessed; the User has withdrawn his or her consent to the processing and the processing has no other legal basis; the User objects to the processing and there is\nno other legitimate reason to continue the processing; the personal data have\nbeen processed unlawfully; the personal data must be erased in compliance with a\nlegal obligation; or the personal data have been obtained as a result of a direct\noffer of information society services to a child under 14 years of age. In addition to\nerasure, the Controller shall, taking into account the technology available and the\ncost of its implementation, take reasonable steps to inform controllers who are\nprocessing the personal data of the data subject's request for erasure of any link to\nthose personal data<\/li>\n
      • Right to restriction of processing:<\/i>\u00a0This is the User's right to restrict the processing\nof his or her personal data. The User has the right to obtain the restriction of\nprocessing where the User contests the accuracy of his or her personal data; the\nprocessing is unlawful; the Controller no longer needs the personal data, but the\nUser needs it to make claims; and where the User has objected to the processing.<\/li>\n
      • Right to data portability:<\/i>\u00a0Where processing is carried out by automated means,\nthe User shall have the right to receive from the Controller his or her personal data\nin a structured, commonly used and machine-readable format and to transmit it to\nanother controller. Where technically feasible, the Controller shall transmit the\ndata directly to that other controller.<\/li>\n
      • Right to object:<\/i> This is the User's right not to have his or her personal data\nprocessed or to have the processing of such data by Argotek cease.<\/li>\n
      • Right not to be subject to a decision based solely on automated processing,\nincluding profiling:<\/i>\u00a0This is the User's right not to be subject to an individualised\ndecision based solely on automated processing of their personal data, including\nprofiling, unless current legislation provides otherwise.<\/li>\n<\/ul>\n

        Therefore, the User may exercise his\/her rights by means of a written communication\naddressed to the Data Controller with the reference \"RGPD-www.argotek.es<\/span>\u00ab, specifying:<\/p>\n

        • Name, surname(s) of the User and a copy of the User's National Identity\nDocument. In cases where representation is permitted, it will also be necessary to\nidentify the person representing the User by the same means, as well as the\ndocument accrediting the representation. The photocopy of the DNI may be\nsubstituted by any other legally valid means that accredits identity.<\/li>\n
        • Request with the specific reasons for the request or information to which access is\nsought.<\/li>\n
        • Address for notification purposes.<\/li>\n
        • Date and signature of the applicant.<\/li>\n
        • Any document that accredits the request being made.<\/li>\n<\/ul>\n

          The Website may include hyperlinks or links that allow access to websites of third parties\nother than Argotek, and which are therefore not operated by Argotek. The owners of such\nwebsites will have their own data protection policies, being themselves, in each case,\nresponsible for their own files and their own privacy practices.<\/p>\n

          COMPLAINTS TO THE SUPERVISORY AUTHORITY<\/h4>\n

          In the event that the User considers that there is a problem or infringement of the\nregulations in force in the way in which his\/her personal data is being processed, he\/she\nshall have the right to effective judicial protection and to lodge a complaint with a\nsupervisory authority, in particular, in the State in which he\/she has his\/her habitual\nresidence, place of work or place of the alleged infringement. In the case of Spain, the\nsupervisory authority is the Spanish Data Protection Agency (http:\/\/www.agpd.es).<\/p>\n

          II. ACCEPTANCE AND CHANGES TO THIS PRIVACY POLICY<\/h3>\n

          It is necessary that the User has read and agrees with the conditions on the protection of\npersonal data contained in this Privacy Policy, as well as that he\/she accepts the\nprocessing of his\/her personal data so that the Data Controller can proceed in the\nmanner, during the periods and for the purposes indicated. The use of the Website\nimplies acceptance of its Privacy Policy.<\/p>\n

          Argotek reserves the right to modify its Privacy Policy, according to its own criteria, or\nmotivated by a legislative, jurisprudential or doctrinal change of the Spanish Data\nProtection Agency.
